TERMS OF USE OF INDIVIDUAL JENNY CARTOONS FOR PRINT PUBLICATIONS
Any individual person, group or company desiring to use any JENNY material for a print publication must do the following:
Publisher must notify the Cartoonist about it and seek same Cartoonist's permission (jewls@jennyspouse.com).
Publisher must supply to the Cartoonist the name of the publication, a general description of the nature of the publication, whether the publication is for profit or not, its frequency of publication (daily, weekly, monthly, etc.), the name(s) of the Publisher and Editor of the publication with addresses, and the number of copies circulated every issue.
For non-profit organization, religious, and educational newsletters, newspapers and periodicals with single-issue circulation of 5,000 copies or less, JENNY allows printing of JENNY cartoons free of monetary charge, granted that the Publisher agrees to conditions posted below and Publisher sends JENNY a copy of the Publication containing the printed JENNY cartoon(s). Periodicals that are produced for profit must contact JENNY concerning monetary price, which is based on the publications single-issue circulation.
Publications that are granted permission by the Cartoonist to use JENNY, whether they be for profit or non-profit, must agree to the following conditions:
Except for altering the size of the cartoon(s) to fit within the layout of the page, Publisher agrees not to change or alter the JENNY cartoon(s) in any way whether it be in wording or drawing. Publishers who desire to make a slight change in the cartoon(s), such as a questionable word or depiction, must seek the permission of the Cartoonist with the description of the alteration he/she wishes to make.
Publisher agrees not to distribute JENNY to any other publication. If another publication desires to use JENNY cartoons, they must get them through JENNY and not through you.
Publisher agrees that the only right granted to them to publish JENNY cartoons is a ONE-TIME printing of a cartoon in a periodical. That is, you are granted permission to print every single JENNY cartoon only one time. Publisher must contact JENNY concerning reprint rights.
Publisher agrees that cartoons supplied to them by JENNY will not be archived in book form, CD-ROM, or by any electronic or digital means, for the JENNY cartoons are copyrighted works and it is strictly prohibited.
Publisher agrees that ownership of the characters, likenesses, and the titles "JENNY", “THE ONLY COMIC STRIP ABOUT LIFE AS A MILITARY SPOUSE”, "PCSING…IT’S A SPOUSE THING", etc., are the property of JENNY and JENNY’S Cartoonist, JULIE L. NEGRON. The rights to publish JENNY granted to Publication is for that purpose only, and does not give Publication any license to produce merchandise or advertising using JENNY cartoons or characters.
The Cartoonist reserves the right to refuse use of JENNY cartoons to any publication the Cartoonist finds objectionable. Among these are periodicals that:
- depict and promote hard-core and/or child pornography,
- promugate religious, racial or ethnic hatred and/or bigotry
- depict and promote cruelty to humans and/or animals,
- promote the overthrow of the United States Government and/or Constitution
- promote activities which are illegal.
IN NO EVENT WILL JENNY (JULIE L. NEGRON) BE LIABLE FOR ANY DAMAGES, INCLUDING, WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF THE USE OF OR INABILITY TO USE JENNY CONTENT THEREON. THIS DISCLAIMER APPLIES, WITHOUT LIMITATION, TO ANY DAMAGES OR INJURY, WHETHER FOR BREACH OF CONTRACT, TORT, OR OTHERWISE, CAUSED BY ANY FAILURE TO MAKE AVAILABLE; ERROR; OMISSION; INTERRUPTION; DELETION; DEFECT; THEFT, DESTRUCTION, UNAUTHORIZED ACCESS TO, ALTERATION OF, OR OTHER USE OF ANY JENNY MATERIAL.
TERMS FOR USE OF INDIVIDUAL JENNY CARTOONS FOR
WEB SITES, E-ZINES AND MESSAGE BOARDS:
Any individual person, group or company wishing to use any JENNY material to feature on a web site,
E-zine or message board must do the following:
User must notify the Cartoonist about it and seek same Cartoonist's permission (jewls@jennyspouse.com).
User must supply the URL of the web page, E-zine, or message board that the JENNY cartoon(s) will appear.
User must give a general description of the web site, E-zine, or message board on which the JENNY cartoon(s) will appear.
User must agree that the JENNY cartoon(s) used will not be changed or altered in any way whether it be in size, wording, or drawing. That is, User must agree that he/she will not add to or take away anything from the JENNY cartoon(s) used without special permission from the Cartoonist.
User must place a link back to the JENNY web site on the page that the JENNY cartoon(s) will appear.
